Agreement to Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you and BookIllustrationAI ("we," "our," or "us") governing your access to and use of our service ("the Service").

User Accounts

Account Creation

To use certain features of the Service, you must create an account. You agree to:

• Notify us immediately of any unauthorized access or security breach

Account Termination

You may terminate your account at any time by contacting us or using the account deletion feature in your settings. Upon termination:

• Your right to access and use the Service will immediately cease
• We will delete or anonymize your personal information in accordance with our Privacy Policy
• You remain responsible for any fees or charges incurred prior to termination
• Provisions that by their nature should survive termination will remain in effect

We reserve the right to suspend or terminate your account at any time, with or without notice, for violations of these Terms, fraudulent activity, or any other reason at our sole discretion. We are not obligated to provide a refund for any unused subscription period in the event of termination for cause.

Intellectual Property Rights

Your Content

You retain all rights to the content you create using our Service, including books and illustrations. By using the Service, you grant us a limited license to:

• Process and store your content to provide the Service
• Use anonymized data to improve our AI models
• Display your content within your account

Our Content

The Service, including its design, functionality, and underlying technology, is owned by us and protected by copyright and other intellectual property laws.

Acceptable Use

You agree not to use the Service to:

• Generate illegal, harmful, or offensive content
• Violate any applicable laws or regulations
• Infringe on the rights of others
• Attempt to gain unauthorized access to the Service

Payment and Subscriptions

Subscription Plans

Some features of the Service require a paid subscription. By purchasing a subscription, you agree to:

• Pay all applicable fees as displayed at the time of purchase
• Provide accurate billing information and payment method details
• Authorize us to charge your payment method for all fees
• Pay any applicable taxes, duties, or fees imposed by your jurisdiction

Billing and Renewal

• Subscriptions automatically renew at the end of each billing period unless cancelled
• You will be charged the then-current subscription fee at the time of renewal
• You may cancel your subscription at any time through your account settings
• Cancellation takes effect at the end of the current billing period
• You will continue to have access to paid features until the end of your billing period

Price Changes

We reserve the right to modify subscription prices at any time. We will provide at least 30 days' notice of any price increases. Price changes will apply to subsequent billing periods. If you do not agree to the new price, you may cancel your subscription before the change takes effect.

Refunds

Refund policies vary by jurisdiction and subscription type:

• We generally do not provide refunds for partially used subscription periods
• Refunds may be provided at our sole discretion in exceptional circumstances
• If you are located in the European Union, you have a 14-day right of withdrawal for digital content subscriptions, unless you have consented to immediate access
• If you cancel within the first 14 days and have not used the Service extensively, you may be eligible for a full refund

Payment Processing

Payments are processed by third-party payment processors (Stripe). We do not store your full payment card information. By providing payment information, you agree to the payment processor's terms and conditions. You are responsible for maintaining valid payment information on your account.

AI-Generated Content

Our Service uses artificial intelligence to generate illustrations. You acknowledge and agree that:

• AI-generated illustrations may not always meet your expectations or requirements
• Results may vary significantly based on your input descriptions, style preferences, and other parameters
• We do not guarantee specific outcomes, quality levels, or artistic styles
• AI models may produce unexpected, inappropriate, or undesirable content despite our safeguards
• You are solely responsible for reviewing, editing, and approving all generated content before use
• You must ensure generated content complies with applicable laws, copyright requirements, and your intended use
• We are not responsible for any issues arising from the use of AI-generated content

Content Ownership and Usage Rights

Subject to your compliance with these Terms, you own the illustrations generated using our Service. However:

• You may not claim that AI-generated content is entirely original or human-created
• You are responsible for ensuring your use of generated content does not infringe on third-party rights
• Some jurisdictions may have restrictions on AI-generated content for certain uses (e.g., copyright registration)
• You grant us a license to use anonymized data from your content to improve our AI models

Prohibited Uses of AI Content

You may not use AI-generated content to:

• Create deepfakes or misleading content that impersonates real individuals
• Generate content that violates applicable laws or regulations
• Create content that infringes on intellectual property rights
• Generate harmful, offensive, or illegal content

Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT GUARANTEE UNINTERRUPTED, SECURE, OR ERROR-FREE OPERATION OF THE SERVICE.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:

• Loss of profits, revenue, data, or business opportunities
• Cost of substitute services
• Loss or damage to content or data
• Business interruption or downtime
• Personal injury or property damage

OUR TOTAL LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR ONE HUNDRED DOLLARS ($100), WHICHEVER IS GREATER.

Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above limitations may not apply to you. In such jurisdictions, our liability is limited to the maximum extent permitted by law.

Indemnification

You agree to indemnify, defend, and hold harmless BookIllustrationAI, its affiliates, officers, directors, employees, and agents from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or relating to:

• Your use of the Service or any content you create using the Service
• Your violation of these Terms or any applicable laws or regulations
• Your infringement of any intellectual property or other rights of any third party
• Any content you submit, post, or transmit through the Service
• Your violation of any third-party rights, including privacy rights

We reserve the right, at our own expense, to assume the exclusive defense and control of any matter subject to indemnification by you, in which case you agree to cooperate with our defense of such claims.

Changes to Terms

Dispute Resolution

Informal Resolution

Before initiating any formal dispute resolution process, you agree to first contact us at support@kindlebookillustrations.com to attempt to resolve the dispute informally. We will make good faith efforts to resolve disputes within 60 days.

Binding Arbitration

If informal resolution is unsuccessful, any dispute arising out of or relating to these Terms or the Service shall be resolved through binding arbitration, except where prohibited by law. Arbitration will be conducted in accordance with the rules of a recognized arbitration organization.

Class Action Waiver

You agree that disputes will be resolved individually and not as part of a class, consolidated, or representative action. You waive any right to participate in class actions, class arbitrations, or similar proceedings.

Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which we operate, without regard to its conflict of law provisions.

For users in the European Union, these Terms are subject to mandatory consumer protection laws of your country of residence, which may provide you with additional rights that cannot be excluded or limited.

Any legal action or proceeding arising out of or relating to these Terms shall be brought exclusively in the courts of competent jurisdiction, except where arbitration is required as described above.

Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining provisions shall remain in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it valid, legal, and enforceable.

These Terms, together with our Privacy Policy and any other legal notices or agreements referenced herein, constitute the entire agreement between you and BookIllustrationAI regarding the Service and supersede all prior or contemporaneous communications, proposals, and agreements, whether oral or written.

Waiver

Our failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision. Any waiver of any provision of these Terms will be effective only if in writing and signed by us.

Assignment

You may not assign or transfer these Terms or your rights hereunder without our prior written consent. We may assign or transfer these Terms or our rights and obligations hereunder to any third party without your consent, including in connection with a merger, acquisition, or sale of assets.
