Terms of Service

1. Agreement

These Terms of Service govern your access to and use of BookIllustrationAI, a subscription service that helps Amazon KDP publishers create coloring book interiors and covers with AI. By creating an account or subscribing, you agree to these terms. If you do not agree, do not use the service.

You must be at least 18 years old and able to enter into a binding contract to use BookIllustrationAI.

2. The service

BookIllustrationAI provides AI-generated coloring pages, cover designs, and KDP-ready PDF exports through a credit-based monthly or annual subscription. Each plan includes a fixed number of credits per billing period. Generating a page, cover, or variation consumes one or more credits.

Credits are issued for the current billing period only. Unused credits expire at the end of each period and do not roll over or convert to cash value. We may adjust the credit cost of individual features as underlying AI model costs change, with advance notice for material increases.

3. Your account

You agree to:

• Provide accurate, current information when signing up
• Keep your password and login credentials secure
• Notify us immediately of any unauthorized access to your account
• Use the service only through your own account (no shared logins or account resale)

You are responsible for all activity that occurs under your account.

4. Subscriptions and billing

Subscriptions are billed in advance through Stripe on a recurring monthly or annual basis, depending on the plan you select. Prices are listed in USD and exclude any applicable taxes, which Stripe collects where required.

• Your subscription renews automatically at the end of each billing period until you cancel.
• You can cancel at any time from the billing settings. Cancellation stops future charges; access continues until the end of the period you have already paid for.
• If a payment fails, we may pause your account access until payment is restored.
• We may change subscription prices with at least 30 days notice by email. New prices apply to your next renewal.

5. Refund policy

All BookIllustrationAI subscriptions are non-refundable. Every coloring page and cover you generate consumes paid AI compute (image-model inference, GPU time, and storage) that we cannot recover after the fact. This cost is incurred whether or not you end up using the credit, which is why we cannot offer refunds for unused credits, partial months, or change-of-mind cancellations.

By starting your subscription you explicitly request immediate access to the service and acknowledge that you lose any statutory right of withdrawal once you have generated your first image.

We do issue refunds in the following cases:

• Duplicate or accidental charges processed within the last 14 days, where no credits from the duplicate charge have been used.
• Technical failures on our side that prevented you from using the service, such as an extended outage, an account-access bug caused by our code, or a broken generation pipeline that charged credits without producing usable output.
• Unauthorized charges on a payment method you can demonstrate was used without your permission.

We do not issue refunds for:

• Changing your mind, forgetting to cancel before renewal, or not using your monthly credits.
• The style, quality, or content of generated images not matching what you imagined. AI image generation is probabilistic; you can regenerate within your remaining credit balance and switch styles or prompts at no extra cost.
• Failed generations where credits were automatically returned to your balance (no money was lost).
• Cancellation mid-period. You keep full access until the end of the period you have already paid for.
• Dissatisfaction with Amazon KDP sales results, BSR, or any commercial outcome of books you publish.

To request a refund for a qualifying case, email support@kindlebookillustrations.com within 14 days of the charge with your account email and a short description of the issue. Approved refunds are returned to the original payment method through Stripe and typically arrive within 5 to 10 business days.

6. Ownership of generated content

You own the coloring pages, covers, and PDF interiors you generate through BookIllustrationAI and may use them for personal and commercial purposes, including publishing them on Amazon KDP and other print-on-demand platforms.

You are responsible for any content you generate. AI models can occasionally produce output that resembles existing styles, characters, or imagery. You agree to review your output before publication and not to publish material that infringes the rights of others.

7. Acceptable use

You agree not to use BookIllustrationAI to generate, store, or publish:

• Sexual content involving minors or any content that sexualizes children
• Content depicting real, identifiable individuals without consent
• Content that infringes trademarks, copyrights, or other intellectual property rights
• Hateful, harassing, or violent content directed at protected groups
• Content intended to deceive, defraud, or impersonate

You also agree not to attempt to reverse engineer the service, scrape our pages, share your account credentials, abuse the credit system, or interfere with the service for other users. We may suspend or terminate accounts that violate this section, without refund.

8. AI providers and third-party services

BookIllustrationAI relies on third-party services to operate, including:

• Stripe for payment processing
• Supabase for authentication, database, and file storage
• Resend for transactional email
• AI image-generation providers for coloring page and cover output

We are not responsible for outages, errors, or changes in these third-party services. If an upstream provider raises prices, deprecates a model, or restricts use, we may adjust the corresponding BookIllustrationAI features or credit costs.

9. Service availability and changes

We aim for high availability but do not guarantee uninterrupted service. BookIllustrationAI is provided on an "as is" and "as available" basis. We may add, modify, or remove features at any time. We will notify subscribers by email of material changes that affect a plan you are on.

10. Disclaimer of warranties

To the maximum extent permitted by law, BookIllustrationAI is provided without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy, or non-infringement. We do not warrant that AI-generated output will meet your expectations, comply with any specific platform's guidelines, or succeed commercially when published.

11. Limitation of liability

To the maximum extent permitted by law, BookIllustrationAI and its operators will not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of revenue, profits, data, or goodwill, arising from your use of the service. Our total aggregate liability for any claim is capped at the amount you paid us in the 12 months immediately preceding the event giving rise to the claim.

12. Termination

You may cancel your subscription at any time from your billing settings. We may suspend or terminate your account if you violate these terms, if your payment fails after reasonable retry attempts, or if we are required to do so by law. Terminations for violation of section 7 do not qualify for a refund.

13. Changes to these terms

We may update these terms from time to time. When we make material changes, we will notify active subscribers by email at least 14 days before the change takes effect. Continued use of the service after the effective date constitutes acceptance.

14. Governing law

These terms are governed by the laws of the Netherlands, without regard to its conflict of laws principles. Any dispute will be resolved in the competent courts of the Netherlands, except where mandatory consumer protection law in your country of residence provides otherwise.
